Welcome to the Tyler’s website terms and conditions, this applies to our website www.tylers-sportswear.co.uk and www.tylershorseandcountry.co.uk

These terms and conditions apply to the use of this website and by access this website and/or placing an order you agree to be bound by the terms and conditions set out below and you are deemed to have understood these terms and conditions. If you do not agree to be bound by these terms and conditions, you may not use this website.

Before you use this website, if you have any questions relating to these terms and conditions, please contact our office on 01707 396900. You are provided with access to this website in accordance with these terms and conditions and any orders placed by you must be placed in accordance to these terms and conditions.

How we use your personal information

Please see our Privacy Policy to see how we use your personal data in line with current UK and EU legislation.

Registration

As a customer, you agree upon registration that the information you provide to us is true, accurate, current and complete in all respects and you will notify us immediately of any changes or errors by contacting our customer service if you placed an order, and by updating your account online.

Purchases through the website

Purchases made on the website will be charged on the day the order is placed using a third party payment provider. We accept all major credit & debit cards for payment, you will be redirected from our website to a secure host website to input your card details, once the transaction has been completed you will be transferred back to our website and an email confirmation will be sent.

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure. As we do not process card payments on our hosting website and do not have direct access to the payment details you provide, we do not accept any liability for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.

The confirmation email will be sent to the email address provided when you registered your details and will contain your unique order number, please quote this order number in all communications with us regarding your order. Once an order has been completed with full payment it is not possible to add to your order, you will need to place a new order.

All items on the website are made to order (apart from some school webshops). Once they have been embroidered with a club/team/company logo they are non-returnable, if you are in any doubt of which items cannot be returned please contact us before placing your order.

Due to stock availability and quick turnaround times, some items may show as in stock on the website but may be out of stock once the order is received. If this happens the customer will be contacted if Tylers cannot provide the item within the timeframe stated on the website and they may be offered a replacement size or colour or offered the chance to wait or cancel. If the customer chooses to cancel a full refund for the out of stock item will be issued within 5-7 working days.

Ordering, cancelling and returning products

Once you have placed an order, if you notice that you have made an error you need to contact us IMMEDIATELY. If you order on a weekend please reply to the email confirmation to avoid the order being processed the following Monday. This applies to cancelling an order too; once an order has been processed and embroidery/printing started we cannot cancel or amend an order.

You may return items from our standard school range within 28 days of delivery or collection providing that the items are in the original packaging, tags intact and are suitable for resale. Return postage in this instance is to be paid by the customer, we recommend using a tracked service to ensure it reaches us safely. At busy periods it may not be possible to contact each customer to inform them that we have received their returns and have processed a refund/exchange. If after 15 days you have not received a refund on to your card/exchange please contact our office and we will look into it for you.

If your school or club does not fall into this list please contact the office to find out the terms and conditions regarding returns.

Unless incorrectly supplied or deemed to be faulty we cannot accept the return of goods that have been embroidered, printed or personalised unless stated above. We will only refund or exchange items which have been sent in error by ourselves, or if they are school stock that we do not personalise.

In the event of goods arriving to the customer with production or manufacturing errors, Tylers reserves the right to correct these prior to offering a refund, at the sole discretion of the Managing Director.

Embroidered/printed logos

We do not hold stock of embroidered items (except for the Schools mentioned above), all the items are plain and we only embroider items which are on orders that are generated from the website.

The club/school/company logo is not our intellectual property, Tylers has permission to replicate the logo from the organisation with the sole purpose of embroidering or printing onto items pre-agreed by the organisation. Therefore we can only embroider/print onto the items which are on the webshop; any requests for the logo to be embroidered or printed onto items not on the webshop will have to have written permission from the person who holds the intellectual property rights to the logo.

Helping you to find the right size/fit

In line with the Long Distance Selling Regulations, Tylers offers you the opportunity to try on plain garments before we embroider them with a logo/personalise them. The easiest way to do this is to order the items you want from the relevant webshop and add to your basket like a standard purchase. Upon checkout, there is a comments box that appears before you complete your payment details, in this box please state you would like to try them plain for sizing. Tylers will then fulfil your request. The customer is responsible for sending them back to us for embroidery/personalisation.

There is also an opportunity to try a select few items in our office showroom, please contact Tylers for more information regarding this service. All Sports Webshop orders must be completed online, we do not take any orders in our showroom, this excludes School Webshops.

We are happy to help with sizing queries, most of our items have chest or waist measurements on the listings and we also have size guides that relate to the sizes. Extra measurements can also be obtained by contacting the Tylers customer service located in the office. 

Description of products

Each product purchased is sold subject to its product description which sets out additional specific conditions related to that product including, without limitation, terms and conditions concerning estimated delivery dates and times.

We will take all reasonable care to ensure that all details, descriptions and prices of the products appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the information including product description and current cut-off dates appearing on this website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of an order until it is accepted by final checkout (with all additional embroidery/print options added and carriage added) and payment being confirmed.

Tylers take great care with the colours used in the collections. The limitations of colour reproduction and the individual colour settings of your screen may mean a slight variation. Every reasonable care has been taken to ensure that the descriptions are accurate however specifications may change.

Shipping & Handling

Goods are not dispatched until full payment has been received. We aim to dispatch all embroidered or printed webshop orders within 10 working days from the cut-off date displayed on the left hand side of the Tylers website. Standard School Webshop orders will be generally be dispatched the same day of ordering if made in the AM (subject to the items being in stock), although some may take up to 3 working days to be dispatched. For plain (non branded) items please allow up to 3 working days for the items to be dispatched. You will receive an email confirmation from our couriers once the order has been dispatched.

If your order is dispatched Monday-Thursday then delivery will be made the following day before 4pm, if your order is dispatched on Friday then delivery will be made the following Monday. We can offer a Saturday service however there is a high premium charge for this. Every opportunity will be made to deliver goods on time but as we use a third party service provider for this, no responsibility can be accepted for late or non-delivery. This responsibility falls within the liability of the courer.

For products delivered within the UK we use a courier as our main delivery service, the courier service we use is APC – Hertfordshire Overnight Services. We deliver to most UK addresses and can deliver to home or work addresses. This service requires a signature upon delivery; if you ask for delivery to your home address please provide a safe place the courier can leave your parcel in the event that you are not in.

All shortages, damage, production errors or non-delivery must be notified to us by telephone within 48-hours and confirmed in writing within 3 working days of dispatch.

Any damaged parcels should be checked in front of the couriers’ delivery person and signed for accordingly.

Delivery charges are as follows;

£0 - £49.99 = £4.99 Delivery charge

£50 - £74.99 = £5.99 Delivery charge

£75 + = Free delivery

There are some postcodes that may have restrictions on the service and/or an extra service charge, these postcodes are shown below.

If your postcode falls into the above postcodes your order may be delivered by courier, or may be delivered by Royal Mail signed for service dependant on the service restrictions in your area. For delivery outside of mainland UK prices are available upon request.

Please allow up to 28 days from dispatch for delivery to non-mainland UK addresses.

UK, the prices shown are inclusive of any value added tax. Due to circumstances beyond our control, prices may have to be altered up or down, including any alterations to the rate of value added tax. The current price will be shown when you place your order. All prices shown are cash prices in sterling.

Limitation of Liability

While we will use reasonable endeavours to verify the accuracy of any information we place on the Website, we make no warranties, whether express or implied in relation to its accuracy.  We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, and reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

Entire Agreement

These Conditions govern our relationship with you. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by these terms and conditions. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions. The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.

We do not exchange or refund items which have been personalised or initialled if they do not fit due to the wrong size being ordered .If you are in any doubt over the size of product you need to order please contact the office and we can either send garments out to try on for size , or measure garments .

We will exchange items for St Columbus College , Kimpton Primary School , Rowans Primary School , Swallowdell Primary School, Ibstock School , Kings College School and any other school which does not require the kit to be initialled or personalised
